REVIEW FOR “AGROINVESTOR” IN THE CASE OF THE VAT REFUND TO THE “RUSSIAN OILS” COMPANY

Olga Romanova, the Managing partner of Ratum Law Group, commented on the case of the VAT refund to the “Russian Oils” Company.
The arbitration court of Krasnodar krai rejected the “Russian Oils” trading company in the VAT refund in the amount of 174,7 million rubles for export of grain.
“Since 2007 the tax service has developed the criteria for companies’ self-assessment of the risks when selecting counterparties, which clarifies measures of due diligence”, says Olga Romanova, the Managing partner of Ratum Law Group. For instance, such companies should pay attention to the existence of official registration in the Uniform State Register of legal entities, the registration at “mass” registration address, as well as the lack of information about the counterparty’s actual location and his production facilities or warehouses. “If such things happen, there might be a high-risk of indicating by tax authorities such counterparty as a problematic person and any transactions with his participation will be considered as doubtful. Having checked the information about several companies mentioned in the court’s decisions, one can say that these firms can attract the attention of tax authorities,” commented Romanova to “Agroinvestor”.
